Artist/Vendor Application Terms and Conditions Please read all terms and conditions prior to submitting your application. Submittal of an application as an artist or vendor constitutes agreement of the artist or vendor to comply with all of the following terms and conditions. Selections Several factors are considered when selecting artists and vendors for Art Outside such as creativity, originality, impact, and design. Selections are made as applications are submitted and are subject to availability of space and additional resources. Art Seen, LLC and Art Outside reserve the right to refuse any application. Deadline Applications must be submitted prior to September 14, 2009. Vendor fees must be paid in full by September 21, 2009. Fees Each participating artist and/or vendor will receive one free pass to the event. Additional passes will be issued for members of bands and performance troupes. Up to two passes will be provided for food vendors. Artist Fee: free if work is not being sold. Vendor Fee: $50 non-food vendor, $500 food vendor Exhibition • Artists may only exhibit work in the medium for which they are accepted. Vendors may only display and sell items for which they are accepted. • Artists work must be original. • Vendors are responsible for all applicable taxes as a result of their sales at Art Outside. • No part of the exhibition space may exceed 10’x10’ without written authorization from Art Outside. • Art Outside does not provide any display materials, lighting, or electrical connections unless otherwise specified. • All installations and vending areas must be set up and operational by the specified opening times and may not be removed or abandoned before the specified closing times. Vendors may keep their booths open beyond the specified closing time if they wish to remain open. Cancellation Art Seen, LLC and Art Outside reserve the right to cancel the Art Outside event if it is determined that the volume and/or quality of applications received prohibit the staging of a successful event. In the event of a cancellation, all applicable vendor fees will be returned. If an artist or vendor decides they are unable to participate in Art Outside, immediate notification is requested. Cancellation by a vendor may result in forfeiture of all vendor fees. Loading and Unloading There will be specific loading and unloading times for all art installations and vending booths. Loading/unloading beyond the specified times is prohibited. Performers and musicians will have a designated entrance to load and unload gear during the event. Additional loading/unloading and setup/breakdown time will be provided for larger installations. No vehicles will be allowed outside of designated parking areas. Liability All artists and vendors and their associates assume entire responsibility and agree to protect, indemnify, defend and save Art Seen, LLC and Art Outside and their officers, members, employees, volunteers and agents against all claims, loss or damage to persons or property arising out of or caused by the artist’s or vendor’s installation, removal, maintenance, occupancy or use of the Apache Pass premises or participation in the Art Outside event. Neither Art Seen, LLC or Art Outside nor their assignees will assume any responsibility for property loss, damage, personal injury or other claims related to the participation of the artist or vendor. Special Effects and Presentations Operational equipment, audio-visual components, and amplified sound must not interfere with the activities of the event and other artists and/or vendors. Termination of Rights In the event the artist or vendor, their contractors, agents, or employees fails to comply with any of these application terms and conditions, or otherwise detracts from the general character of the event, Art Seen, LLC and Art Outside is permitted and empowered to terminate the artist’s or vendor’s rights, and evict and remove the artist or vendor from the premises, in which event the artist or vendor is not entitled to any refund or payment.
